Defending You Against a Second or Third DUI
The penalties for anyone who is caught driving under the influence of alcohol
or drugs a first time are severe, and are designed to be sufficiently
harsh as to prevent the individual from committing a repeat offense. If
you have been arrested for drinking and driving for second, third or fourth
time, you are at risk of receiving a sentence which could have a devastating
impact on your life, and must take action now to prevent a negative outcome.

What are the penalties for a repeat DUI in Orlando, FL?
In the event that this is your second arrest for DUI, you are at risk of
being fined up to $2,000, sent to jail for nine months and being subjected
to a driver's license revocation lasting for up to a year. If the
prior offense occurred less than five years ago, the revocation will be
extended to a minimum of five years, while the term of imprisonment must
include at least ten days, forty-eight hours of which must be served consecutively.
A third DUI conviction which occurs more than ten years later than the
second offense is punishable by a fine between $2,000 and $5,000, up to
one year in jail and a license suspension lasting between 180 days and
a year. If the second conviction was less than five years ago, the revocation
is extended to five years. In cases where all three offenses occur within
a period of ten years you can be charged with felony DUI, for which thirty
days in jail are mandatory, and you can be subjected to a ten-year driver's
license revocation. The minimum fine for a fourth DUI offense is $2,000,
in addition to a prison sentence of up to five years and a permanent revocation
of your driving privileges.

and holidays. The strategies involved in defending charges of repeat DUI
are generally the same as in any other case, such as by challenging the
evidence of field sobriety tests or
breathalyzer tests, but success in the case depends on taking action as early as possible
to allow sufficient time to develop an effective plan of action.
