What is the sentence for drunk driving in Orlando?
Driving under the influence of drugs or alcohol is not merely a traffic
violation in Florida, it is a criminal offense which is punishable by
harsh penalties. If you or a loved one have recently been arrested on
charges of
DUI, it is important to fully understand the magnitude of the situation, so
that you can take appropriate action to defend yourself against the widespread
disruption which could follow in the wake of a conviction. The penalties
for drunk driving depend on whether it is the first time the individual
has been arrested for this crime or if the driver has
multiple DUI convictions in the past:
First Conviction
A first time arrest for DUI is punishable by a maximum fine of $1,000,
community service for 40 hours, up to six months in jail and up to a year
on probation, ten days of vehicle impoundment and a driver's license
suspension lasting between 180 days and a full year. The driver may additionally
be required to pay for the installation and ongoing maintenance of an
ignition interlock device, which requires a breath sample before starting
the car and at random intervals while driving.
Second Conviction
Fine of up to $2,000, maximum jail term of nine months with a mandatory
minimum of ten days if it is the second conviction within five years,
thirty days of vehicle impoundment, and same term of license suspension
as for a first conviction unless this is the second offense within five
years, in which case the suspension will be for a minimum of five years.
Third Conviction
Minimum fine of $2,000 or a maximum of $5,000, at least thirty days in
jail with a minimum of forty-eight consecutive hours and up to one year,
ninety days of vehicle impoundment and a minimum ten-year revocation of
driving privileges
Fourth Conviction
Felony DUI offense with a minimum fine of $2,000, up to five years in state prison
and permanent driver's license revocation. Note: It is also possible
to be convicted of
felony DUI for a third offense occurring within ten years.
